Ok Honey Ventures LLC, a Wisconsin limited liability company (“Growing Up Rooted,” “us” or “we”) owns and operates this website and any other web services or products offered by Growing Up Rooted now or in the future, including, but not limited to, its related social media platforms. By accessing, using, downloading, viewing this website, or any of its services, products, e-courses, programs, resources, or Content (defined below) (collectively, the “Site”), you hereby consent and agree to these terms and conditions (“Terms of Use”). The Terms of Use and Privacy Policy (please see here) (collectively, the “Terms”) govern your use of the Site, and other free materials and resources provided by the Site, and any other services or products we make available on this Site (collectively, the “Services”). These Terms constitute a legally binding agreement made by and between Growing Up Rooted and the user of this Site (personally and, if applicable, on behalf of the entity for whom you are using the Site; collectively, “you”).

No aspect of Growing Up Rooted’s Products or Services are meant to be a substitute for professional advice from your professional care provider and Growing Up Rooted makes no warranties, express or implied, as to the completeness, accuracy, or appropriateness for any purpose of any information or instruction provided through the Services. You acknowledge and agree that when taking any action or participating in any activity, routine or program that may be described in the Services that there is the possibility of physical injury, emotional distress and/or death, and you assume the risk and responsibility for any such results.
You should never disregard medical or other professional advice or delay seeking it. Growing Up Rooted’s Services should not be used in lieu of professional advice given by qualified medical professionals such as your doctor or other professional care provider. It is important that the Services are used only in conjunction with qualified medical guidance and guidance provided by other applicable professional care providers.
You hereby release Growing Up Rooted and waive any and all claims against Growing Up Rooted for any damages you may incur arising out of or related to your use of Growing Up Rooted’s consulting Services, Site, or Products. You further agree to indemnify and hold harmless Growing Up Rooted from any damages, liabilities, losses, or other claims incurred by Growing Up Rooted and arising out of or related to your use of Growing Up Rooted’s consulting Services, Site, or Products.
PROP 65 WARNING
Proposition 65 is a unique California law that requires businesses to include a warning on any products that contain quantifiable amounts of over 800 possible chemicals, many of which are naturally occurring.
Some botanicals (even those grown and processed organically) contain low levels of lead which is often naturally occurring. We source our plant material from two companies: Starwest Botanicals in Sacramento, California, and Mountain Rose Herbs in Eugene, Oregon. Both companies test all ingestible products for Lead, Cadmium, Mercury and Arsenic and their botanical products are well below FDA's current tolerable intake levels (and many times less than the amount shown to cause harm in adults).
We apply the warning to our products to protect our company from lawsuits by individuals and groups looking for businesses that allegedly do not comply with Prop 65.

CONTENT ON THE SITE
Intellectual Property Rights
You agree that the Site itself, as well as all content, photographs, sound or videos, media, images, formulas, graphics, webinars, training materials, products, podcasts, services and/or other information and materials, and selection and arrangements thereof is copyrighted work under the United States and other copyright laws, and is the property of or licensed by Growing Up Rooted, made available on the Site or any information, materials, and content transferred via a downloadable file or link by us or other third parties (collectively the “Content”). All trademarks, service marks, and trade names (collectively, the “Marks”) are trademarks or registered trademarks of and are proprietary to Growing Up Rooted or other respective owners that have granted Growing Up Rooted the right to use such Marks.
Subject to your compliance with these Terms, we hereby grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access, view, and use the Site solely for your personal purposes and non-commercial use, and as we otherwise intend.
Growing Up Rooted reserves the right to monitor the Services and Content for the purpose of determining that your usage complies with these Terms.
You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or Content on our Site in whole or in part, other than as necessary for your own personal non-commercial use, without our written consent.
Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of Growing Up Rooted, as well as other authors who created the materials, and may be subject to monetary damages and penalties.

DISPUTES
Informal Resolution
If you have any dispute with us, you agree that before taking any formal action, you will contact us at hello@growinguprooted.com, provide a brief, written description of the dispute and your contact information (including your username, if your dispute relates to an account) and allow sixty (60) days to pass, during which we will attempt to reach an amicable resolution of any issue.
Judicial Forum for Legal Disputes
Unless you and we agree otherwise, in the event that the agreement to arbitrate above is found not to apply to you or to a particular claim or dispute, either as a result of your decision to opt out of the agreement to arbitrate, as a result of a decision by the arbitrator or a court order or because you have chosen to file an eligible lawsuit in small claims court, you agree that any claim or dispute that has arisen or may arise between you and Growing Up Rooted must be resolved exclusively by a state or federal court located in Walworth County, Wisconsin. You and Growing Up Rooted agree to submit to the personal jurisdiction of the courts located within Walworth County, Wisconsin for the purpose of litigating all such claims or disputes.
OPT-OUT
IF YOU ARE A NEW GROWING UP ROOTED USER, YOU CAN CHOOSE TO REJECT THE AGREEMENT TO ARBITRATE PROVISION ("OPT-OUT") BY EMAILING US AN OPT-OUT NOTICE TO hello@growinguprooted.com ("OPT-OUT NOTICE"): GROWING UP ROOTED.
Procedure
In order to opt-out, you must email your name, address (including street address, city, state, and zip code), and email address(es) associated with your Account(s) to which the opt-out applies and an unaltered digital image of a valid driver’s license which matches the name on your account to: hello@growinguprooted.com.
GENERAL TERMS
Applicable Law
These Terms will be construed in accordance with the laws of the United States of America and (to the extent not inconsistent with or preempted by federal law) the State of Wisconsin and the parties irrevocably consent to bring any action to enforce these Terms before an arbitration panel or before a court of competent jurisdiction in Walworth County, Wisconsin, if seeking interim or preliminary relief or enforcement of an arbitration award.

We may deliver notice to you by e-mail, posting a notice on the Site or any other method we choose and such notice will be effective on dispatch. The Site is controlled and offered by Growing Up Rooted from the United States of America. Growing Up Rooted makes no representations that the Site is appropriate for use in other locations. Those who access or use the Site from other locations do so at their own risk and are responsible for compliance with local law.
